Introduction

These Terms of Service govern access to and use of the Condorgreen website, digital platforms, online forms, downloadable content and related online services. The website is operated by Condorgreen (Pty) Ltd, referred to as “Condorgreen”, “we”, “us” or “our”.

By accessing or using this website, you acknowledge that you have read and understood these Terms and agree to be bound by them. Where you use the website on behalf of a company, organisation or other legal entity, you confirm that you are authorised to accept these Terms on its behalf.

These Terms must be read with our Privacy and POPIA Notice, PAIA process, any cookie notice, and any proposal, quotation, statement of work or other written agreement concluded with Condorgreen.

About the website

The website provides general information about Condorgreen’s managed technology and infrastructure services, application and database development, analytics and artificial intelligence, automation, smart technology solutions, digital transformation, innovation consulting, technology relationships, social-impact initiatives, discovery sessions and legal request processes.

Website content is provided for general information and business-enquiry purposes. It is not a binding offer unless expressly stated otherwise in writing.

Eligibility and authority

You may use this website only if you have legal capacity to enter into a binding agreement, use it for lawful purposes, provide accurate information and do not impersonate another person or misrepresent your authority. A person submitting information for another individual or organisation confirms that they have authority to do so.

Website use

You may view, download and print website content for legitimate personal or internal business use. Without our prior written permission, you may not republish or commercially exploit content, copy substantial portions of the website, remove proprietary notices, create misleading associations with Condorgreen, scrape or harvest content, reverse engineer website software, bypass security controls or place an unreasonable load on the website.

Acceptable use

You must not use the website to commit or facilitate unlawful, fraudulent or harmful activity; introduce malicious code; test or probe systems without written authorisation; attempt unauthorised access; intercept data; submit abusive or infringing content; send unsolicited bulk communications; misrepresent communications; or disrupt availability. We may restrict access where we reasonably suspect misuse or a threat to systems or users.

Enquiries, forms and electronic communications

The website may allow contact enquiries, discovery-session requests, PAIA requests, privacy enquiries, complaints, supporting documents and other business communications. Submitting a form does not automatically create a contract, confirm an appointment, approve a PAIA request or oblige Condorgreen to provide services.

A request is received only once it reaches the designated Condorgreen system or email address in readable form. An automated acknowledgement confirms receipt only. You consent to communications relating to your enquiry through the contact details supplied.

Proposals, quotations and service agreements

Website information is not a quotation or contractual commitment. Consulting, development, implementation and managed services are governed by separate written commercial terms, which may address scope, pricing, assumptions, responsibilities, service levels, change control, licensing, support, data processing, security, intellectual property and termination. Where a signed agreement conflicts with these Terms, the signed agreement governs the relevant services.

Artificial intelligence and automated technologies

Some services may incorporate artificial intelligence, automation, analytics, machine learning or third-party platforms. Unless expressly agreed otherwise, automated outputs may contain errors or omissions, depend on the quality of supplied data, require appropriate human review and must not be treated as professional, legal, financial or regulatory advice. No automated system is guaranteed to be uninterrupted, error-free or suitable for every use case.

Third-party services and links

The website may refer or link to third-party websites, cloud services, software providers, manufacturers or channel partners. These links are provided for convenience. Condorgreen does not control or guarantee third-party availability, security, content or privacy practices. Use of third-party services is governed by their own terms and policies.

Intellectual property

All rights in the website and its original content belong to Condorgreen or its licensors, including text, brands, logos, graphics, interface designs, software, reports, methodologies, media and data compilations. Third-party names and marks remain the property of their owners. No intellectual-property right is transferred merely because you access or use the website.

User-submitted information

You retain ownership of material you submit. You grant Condorgreen permission to receive, store, review, copy and process it only as reasonably required to respond, assess a service, process a legal request, deliver services, keep records, protect rights or comply with law.

You warrant that submitted information is accurate to the best of your knowledge, may lawfully be provided, does not infringe third-party rights and contains no malicious code. Do not use a general contact form for confidential, privileged or highly sensitive information unless specifically requested or an appropriate channel has been agreed.

Personal information and privacy

Condorgreen processes personal information in accordance with its Privacy and POPIA Notice and applicable South African law. Information submitted through the website may be processed to respond to enquiries, manage relationships, provide services, process legal requests, maintain security, prevent fraud, meet legal obligations and keep operational records.

PAIA requests

Requests for access to records are governed by the Promotion of Access to Information Act 2 of 2000, applicable regulations and Condorgreen’s PAIA process. Submitting an online request does not guarantee access. Requests may require proof of identity or authority, sufficient record particulars, applicable fees, statutory time periods and third-party procedures, and may be subject to lawful grounds for refusal.

Security

Condorgreen takes reasonable steps to protect its website and systems, but no internet-based service can be guaranteed completely secure or continuously available. You are responsible for using secure devices and networks, protecting accounts and credentials, verifying communications, retaining copies of important submissions and avoiding malicious files. Notify us promptly of suspected misuse, impersonation, fraud or a security incident involving Condorgreen.

Website availability and changes

We may modify content, correct errors, add or remove functionality, suspend access, perform maintenance, change links or discontinue features without prior notice. We do not guarantee continuous availability, error-free operation or compatibility with every browser or device.

Accuracy of information

Condorgreen aims to keep content current and accurate but does not warrant that all content is complete, error-free, current, suitable for a specific purpose or applicable to every organisation. Technology offerings, partnerships, certifications, capabilities and legal requirements may change. Specific representations must be confirmed in an authorised written proposal or agreement.

No professional advice

Website content is general information and is not legal, tax, financial or regulatory advice; an audit opinion; a guarantee of compliance or cybersecurity; or a representation that all risks can be eliminated. Obtain appropriate professional advice before acting on information that may materially affect your organisation.

Warranties

To the maximum extent permitted by law, the website is provided on an “as available” basis. Condorgreen does not warrant continuous availability, freedom from faults or malicious code, complete accuracy, universal compatibility, achievement of a commercial result or fitness for a specific purpose. Nothing excludes a right or remedy that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, Condorgreen will not be liable for indirect, incidental, special or consequential loss arising solely from use of the public website, including loss of profit, opportunity, data, reputation or business continuity. This does not exclude liability that cannot lawfully be excluded. Liability relating to paid services is governed by the relevant written agreement.

Indemnity

To the extent permitted by law, you indemnify Condorgreen against claims, losses or reasonable costs arising from unlawful website use, infringement of third-party rights, malicious submissions, materially false information or a material breach of these Terms. This does not apply to loss caused by Condorgreen’s unlawful conduct, gross negligence or wilful misconduct, or where prohibited by law.

Suspension and termination

Condorgreen may suspend or terminate access where reasonably necessary to protect security, prevent abuse, comply with law, investigate misconduct, protect rights or maintain system integrity. Provisions that should survive termination remain effective, including intellectual-property, privacy, liability and dispute provisions.

Direct marketing

Condorgreen manages electronic direct marketing in accordance with applicable law and its Privacy and POPIA Notice. Where consent is required, it may be withdrawn through an unsubscribe mechanism or by contacting us. Operational messages concerning an enquiry, transaction, project, legal request or existing business relationship are not necessarily marketing communications.

Complaints and disputes

Please first direct website-related complaints to Condorgreen so that we have a reasonable opportunity to investigate and respond. The parties should attempt good-faith resolution before formal proceedings unless urgent relief is required. Nothing prevents a person from approaching a competent court, regulator, ombud or statutory authority where entitled to do so.

Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Subject to mandatory consumer or statutory jurisdiction, disputes fall under the jurisdiction of a competent South African court. Use of the website outside South Africa does not mean foreign law governs Condorgreen’s operation of the website.

Changes to these Terms

Condorgreen may revise these Terms when its website, services, operations or legal obligations change. The latest version will be published here with an updated effective date. Continued use after publication constitutes acceptance to the extent permitted by law. Material changes apply prospectively unless law permits or requires otherwise.

General provisions

Severability

If a provision is invalid or unenforceable, it will be limited or interpreted as far as legally possible and the remaining provisions will continue.

No waiver

A failure or delay to enforce a provision is not a waiver. Any waiver must be in writing and applies only to the stated circumstances.

Entire website agreement

These Terms and incorporated policies govern use of the public website. They do not replace a signed proposal, service agreement, statement of work, non-disclosure agreement or data-processing agreement.
